MURRAY AMERICAN ENERGY, INC. FRANKLIN COUNTY COAL COMPANY FRANKLIN COUNTY MINE PERMIT NO. 43 REVISION 9, ISSUED DECEMBER 20, 2011 PUBLIC NOTICE OF COMPLETED RECLAMATION AND REQUEST FOR BOND RELEASE This publication is to give notice Franklin County Coal Company (FCCC) has filed with the Illinois Department of Natural Resources, Office of Mines and Minerals, Land Reclamation Division an application to release bond at the Franklin County Mine in Jefferson County.The map contained in this notice illustrates the location of the proposed bond release area and its relationship to local features sufficient to allow local residents to readily identify the proposed bond release area. FCCC is requesting Phase I release (60%) on 239.2 acres, Phase II release (25%) on 239.2 acres, and Phase III release (15%) on 0.0 acres. An applicable portion of the existing bond is being requested for release. The proposed bond release area is within the 685.3 acres represented in Permit 43, Revision 9. The amount of surety bond held with the Department for this permit to guarantee performance of the reclamation plan is $5,735,244. Phase I and II release is requested on 239.2 acres of limited capability Fish and Wildlife Habitat – Herbaceous land use. Release area is located in Sections 29, 30, 31, and 32, Township 4 South, Range 2 East. A portion of the area was affected prior to implementation of the Permanent Program and the remaining area affected from 1983 – 1991. Phase 1 grading was completed in 2011 and final permanent seeding in 2012. Written comments or objections to the proposed bond release and requests for public hearing pursuant to 62 IL Adm. Code 1800.40(d), may be filed with the Department by any person with a valid legal interest which might be adversely affected by release of the bond or the responsible officer or head of any Federal, State, or Local governmental agency which has jurisdiction by law or special expertise with respect to any environmental, social, or economic impact involved in the operation or which is authorized to develop and enforce environmental standards with respect to such operations. All written comments, objections, and requests for public hearing shall be filed with the Illinois Department of Natural Resources, Office of Mines and Minerals, Land Reclamation Division, One Natural Resources Way, Springfield, Illinois 62702-1271 within thirty (30) days following the last advertisement of this notice.
