MARION — The man arrested for the death of his 3-month-old son last month has had first-degree murder added to the list of charges he faces in Williamson County.

A news release from Williamson County State’s Attorney Brendan Zanotti said that on Wednesday, Devin O'Daniell, 25, of Marion, had first-degree murder added to the other charges of domestic battery, aggravated domestic battery and aggravated battery to a child in the case.

In the release, Zanotti said his office is still awaiting medical records from a St. Louis hospital where the baby was pronounced dead and said once those are made available, more charges could be considered.

As previously reported by The Southern, officers responded to a call at about 9:39 p.m. Nov. 23 in Marion — a woman reported that her child was being abused. The woman was gone when officers arrived, however, the baby's father, O’Daniell, was seen walking away from the area. He was taken to the Marion Police Department.

The mother was not named, but she had already taken the infant to Heartland Regional Medical Center when police arrived. He was later transported to Cardinal Glennon Children’s Hospital in St. Louis, where he died at 4:04 p.m. Nov. 26.

O’Daniell is scheduled for a preliminary hearing in the case at 10:30 a.m. Dec. 18 and is being held on $1 million bond.
